2.1. FRIS Nederland B.V. respects and attaches great importance to the privacy and protection of your personal data. “Personal data” means any information relating to an identified or identifiable natural person (the “data subject”).

3. WHICH CATEGORIES OF DATA DO WE PROCESS?

3.1. It could be that FRIS Nederland B.V. collect or otherwise process the following personal data:

  • your address, email, telephone number or other contact details;
  • information about the use you make of our products or services.

3.2. If you apply for a vacancy at FRIS Nederland B.V., you may also be asked to provide us with the following information:

  • date of birth and/or identification number;

4. HOW DO WE COLLECT YOUR PERSONAL DATA?

  • via FRIS Nederland B.V. campaign websites, online forms;
  • via telephone contact;

5. PROCESSING PURPOSES: WHY DO WE PROCESS YOUR PERSONAL DATA?

5.1. The collection and processing of the above types of personal data is necessary for us to achieve specified legitimate purposes in the performance of our business activities. We process your personal data in particular for the following purposes:

  • provision of our security services and products;
  • improving our services and products;
  • customer administration, for example to respond to customer requests or questions, customer satisfaction surveys or the handling of complaints about a particular product or service;
  • for supplier administration;
  • for administration and management of personnel and intermediaries;
  • for the management of commercial relationships with third parties;
  • for administrative purposes within the FRIS Nederland BV;
  • for backup or archival purposes;
  • with regard to our legal duties towards the government or in the context of legal proceedings;
  • for statistical research or market research;
  • for (direct) marketing purposes;
  • to combat fraud and customer breaches;
  • for dispute resolution;
  • to protect society, your own sector or organization;

  • for credit acceptance and management thereof;
  • for an overview of customers;
  • for the management of personal insurance.

5.2. FRIS Nederland B.V. strives not to (further) process your personal data in a manner that is incompatible with the above-mentioned purposes.

6. LEGAL BASIS FOR PROCESSING YOUR PERSONAL DATA

6.1. FRIS Nederland B.V. aims to process your personal data lawfully, i.e. on the valid legal basis, as set out below.

6.2. In particular, your personal data will be processed if necessary for the performance of the contract between you and us, or to take steps at your request prior to concluding a contract.

6.3. Your personal data may be processed based on your consent. In that case, we will always ensure that we have your free, specific, informed and unambiguous consent.

6.4. Your personal data is processed on the basis of the legitimate interests pursued by us for, for example, administrative purposes, or for research or development purposes. For example, when processing your personal data for communicating with you, improving the quality of our products and/or services, providing marketing information to you (including direct marketing), for personnel and payroll administration, the development and implementation of HR strategies and management of our business operations and IT infrastructure. 6.5. Your personal data may be processed because it is necessary to comply with a legal obligation to which we are subject.

6.6. Your personal data is processed because it is necessary to protect someone's vital interests (e.g. in the event of accidents or incidents) or because it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us has been assigned.

8. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

8.1. FRIS Nederland B.V. undertakes to comply with the storage limitation principle. In this context, we will not store your personal data for longer than necessary for the execution of our contract and/or to achieve one of the above-mentioned purposes (see article 5 above,
'Processing purposes: why do we process your personal data'). FRIS Nederland B.V. may also be required by law to store your personal data for a minimum period of time to comply with legal requirements.

8.2. We will regularly check whether personal data that no longer serves a purpose can be deleted or otherwise anonymized.

9. WHAT ARE YOUR RIGHTS AS A DATA PARTY?

9.1. FRIS Nederland B.V. will do its utmost to respect and realize your rights as a data subject, as listed below.

9.2. Your rights as a data subject consist of:

  • The right of access: you may request access to your personal data at any time. Upon request, we will provide you with a copy of the personal data that we process about you. For further copies we charge a reasonable fee based on administrative costs. If you submit your request electronically and do not request any other arrangement, the information will be provided in a commonly used electronic format.
  • The right to rectification: You have the right to request the rectification or completion of inaccurate or incomplete personal data relating to you.

9.3 The right to be forgotten: you may request us to Delete (part of) your personal data in the following situations:

  • when the processing was based on your consent and you have decided to withdraw this consent;
  • when your data is no longer necessary to achieve the purposes for which it was collected or otherwise processed;
  • when you have objected to the processing of your data for direct marketing purposes;
  • where you have objected to the processing of your data (see 'right to object' below) and after verification it appears that your rights, freedoms or personal interests outweigh our legitimate interests;
  • when your personal data has been processed unlawfully (e.g. because your consent was not validly obtained); when your personal data must be erased to comply with a legal obligation FRIS Nederland B.V. peace.

9.6. If you exercise your right to restriction of processing, we may process your data with your consent, with the exception of its storage.

9.7. The right to data portability: upon request, in certain cases you have the right to obtain your personal data in a structured, commonly used and machine format
readable form, to transfer this data to another entity. If technically possible, you may request that we transfer your personal data directly to this other entity.

9.8. Your right to portability should not affect the rights and freedoms of others.

9.9. The right to withdraw your consent: if the processing is based on your consent, you are free to withdraw your consent at any time.

9.10. If you contact us to exercise the above rights, please attach a copy of your identity card or passport so that we can check whether this request is indeed from you.

9.11. If you have any issues regarding your personal data or other privacy concerns, you can also file a complaint with the Dutch Data Protection Authority.

10. HOW DO WE ENSURE THE PROTECTION OF YOUR PERSONAL DATA?

10.1. FRIS Nederland B.V. attaches great importance to the protection of your data. We, at FRIS Nederland B.V., takes all administrative, technical and organizational measures to ensure the protection and confidentiality of your personal data and to protect your personal data against access, loss, misuse, disclosure, modification or destruction, whether accidental or unlawful.

10.2. Prior to providing your personal data to a third party / processor, we will always ensure that this third party / processor offers an adequate level of security.

11. How do we protect your data?

We have taken appropriate security measures to protect your data. We have recorded this in our security policy. Below you will find some examples.
a. We take extra measures for special or sensitive data. This is, for example, the case with your security services that you purchase from us. We will then provide additional safeguards to protect your data. For example, by not sending your file or messages about your file via e-mail, but via an extra secure connection.
b. We regularly test, assess and evaluate whether the technical and organizational security measures are appropriate. If it appears that additional measures are necessary, we will strive to take these measures as soon as possible.
c. Our server is located in the Netherlands and is not accessible to third parties.
d. We do not have normal waste bins for throwing away paper, but we have paper safely destroyed by a shredder.
e. We have strict access rights. Only those who need information based on their position have access to the data.
f. We only use suppliers who protect data in the same way as we do. We have made good agreements with them about security.

We process your personal data on our own server in an extra secure environment in Arnhem. We do not use suppliers or other companies that process your personal data.

12. What can you do if you have a complaint?

If you have a complaint, you can always contact us or our Data Protection Officer (FG) by post and/or by email. Our FG will then investigate your complaint and look for a solution where possible. 13. If you want to become a customer

If you request a service from us, you provide us with all kinds of personal data. We need this information to assess your application. If no service is provided, we will delete this data one year after the quotation period ends. In that year we only use this data for statistical research, with which we improve our products and the application process.

13.1. If you are a customer
As long as you have services (services) with us, we store the personal data we need to perform your services.

13.2. If you are no longer a customer
After termination of a (agreement) service, we retain your personal data for another 6 months.

14. Financial administration

We must keep data from the financial administration that is important for the tax authorities for at least seven years. These are, for example, invoice/VAT data showing which services we have invoiced to you and how much tax we have paid.

15. If you work for us

If you join us, we will store all kinds of information about you in our administration. For example:

  • Your name, contact details and date of birth;

  • Email and mobile phone details (number);
  • Emergency alert addresses for your partner (mobile number or landline);
  • Amount of your salary;
  • Wage tax statements and copies of IDs, diplomas;
  • Your bank account number;
  • VOG and application screening (special police laws);
  • Clothing sizes for your uniform;
  • Your job job description;
  • Other financial agreements in accordance with company agreements and/or collective labor agreements;
  • Reports of performance reviews;
  • Sick leave.

16. There are several reasons why we may or must process your personal data:

Because we need your data to execute your employment contract. 'Execution of the agreement' includes, among other things:

  • maintaining personnel and payroll administration, so that we can, for example, pay your salary;
  • implementing an absenteeism and reintegration policy, so that we can, for example, provide you with proper guidance if you are ill and help you return to work as quickly as possible;
  • testing whether our employees are competent and reliable.

This applies not only to employment contracts, but also to temporary employment contracts, secondment agreements or agreements with a supplier.
Because the law requires us to record your data. This concerns, for example, the obligations we have to:

  • to pay payroll tax;
  • to determine the identity of our employees and to pass this information on to an authority that is authorized to request it;
  • to maintain administration that makes it clear how we stand financially. For example, our administration must clearly show how much salary and holiday pay we still have to pay out and whether we have enough financial reserves for this.

Because we have an interest that justifies processing your data. It is important to us that we conduct our business activities in a controlled and honest manner. For us, this means, among other things, that we pursue a sound personnel policy and that our employees meet all professional competence requirements. If it is necessary to process personal data, we may do so. Another example is the security of our company. To secure our business premises, for example, we store data about who is present and absent.
